Policy Return,Refund and Cancellation

 

Straker Marketing Limited (The Company which expression shall include its officers and/or employees and/or agents).

   The Company has informed the Purchaser that it does not manufacture the goods and items which it sells by retail and makes no representations regarding the fitness and quality of any of the goods and items.

   The Purchaser has examined the goods or items being purchased and other than stated herein no warranty description on the part of The Company is given or implied, nor is any warranty condition, description or representation to be taken to have been given or implied from anything said or written in negotiations between The Company and the Purchaser or their respective representatives prior to the execution hereof by the Purchaser and any statutory or other warranty condition or description expressed or implied as to the state, quality and fitness of any of the goods or items subject hereto is hereby expressly excluded.

   In the event that any of the goods or items fails to perform the function or functions for which it or they were reasonably intended to perform the Purchaser shall notify The Company of such failure or failures within 30 days from the date of receipt of the items by the Purchaser and may return any and each of the goods or items to The Company’s office during regular office hours and The Company shall be entitled to examine each of the said goods and/or items so returned to determine whether any of the said goods and/or items were damaged by the Purchaser due to the Purchaser’s own negligence and/or by accident and/or misuse.

   If The Company is satisfied that the said failure by any of the goods or items is not as a result of any act or failure or negligence of the Purchaser, The Company may either:

  • Give the Purchaser a refund; or
  • Replace the goods and/or items; or
  • Give the Purchaser a credit equivalent to the purchase price of the said items and/or goods to be used by the Purchaser when purchasing further goods or items from The Company.
